New Jersey counts the IRA of a community spouse and an institutionalized spouse. In the Mistrick case, the New Jersey Supreme Court indicated that resolution of the issue of countability should be decided by the New Jersey Assembly. The New Jersey Assembly has not yet acted on the issue.
